the purpose of defining certain terms; prohibiting the
use of employment of minors in certain acts for certain

purposes; prohibiting the sale, distribution,

exhibition, publication, or printing of certain matter

depicting minors in certain acts; prohibiting the

importation of certain matter involving minors;

providing a penalty; and clarifying language providing
that any person who solicits, causes, induces or

knowingly permits a person under a certain age to
engage as a subject in the production of obscene matter
is subject to certain penalties; and providing that
persons who photograph or film a child under a certain

age engaging in an obscene act is subject to certain

penalties.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

417.

Article 27 - Crimes and Punishments

As used in this subtitle,

           (5)

YEARS OF AGE.

"MINOR" MEANS ANY NATURAL PERSON UNDER 18

(6) "OBSCENE MATTER" MEANS ANY MATTER WHICH

TAKEN AS A WHOLE TO THE AVERAGE PERSON, APPLYING

CONTEMPORARY STATEWIDE COMMUNITY STANDARDS, APPEALS TO

PRURIENT INTEREST, AND IS MATTER WHICH, TAKEN AS A WHOLE,

DEPICTS OR DESCRIBES IN A PATENTLY OFFENSIVE WAY SEXUAL

CONDUCT AND WHICH, TAKEN AS A WHOLE, LACKS SERIOUS LITERARY,
ARTISTIC, EDUCATIONAL, OR SCIENTIFIC VALUE.

(A) A PERSON MAY NOT EMPLOY OR USE ANY MINOR FOR THE

PURPOSE OF ENGAGING IN SEXUAL INTERCOURSE, MASTURBATION,
