2926                                     LAWS OF MARYLAND                                 Ch. 1016

SODOMY, BESTIALITY, ORAL COPULATION, OR OTHER SEXUAL ACTS
FOR ANY COMMERCIAL PURPOSES, PURPOSE INCLUDING DISPLAY IN

ANY MANNER.

(B) A PERSON MAY NOT KNOWINGLY SELL, DISTRIBUTE,

EXHIBIT, PUBLISH, OR PRINT ANY OBSCENE MATTER PRODUCED IN

THIS STATE DISPLAYING A MINOR ENGAGED IN ANY ACT DESCRIBED

IN SUBSECTION (A).

(C) A PERSON MAY NOT KNOWINGLY SEND OR CAUSE TO BE

SENT, OR BRING OR CAUSE TO BE BROUGHT, INTO THIS STATE FOR

SALE OR DISTRIBUTION ANY OBSCENE MATTER WHICH DEPICTS SEXUAL

CONDUCT INVOLVING ONE OR MORE MINORS.

(D) VIOLATION OF THIS SECTION IS PUNISHABLE UPON

CONVICTION BY FINE OF NOT TO EXCEED $10,000 OR BY

IMPRISONMENT FOR NOT TO EXCEED FIVE YEARS OR BOTH. ANY

SUBSEQUENT CONVICTION OF A VIOLATION OF THIS SECTION IS

PUNISHABLE BY A FINE OF NOT TO EXCEED $20,000 OR

IMPRISONMENT FOR NOT LESS THAN FIVE YEARS OR MORE THAN TEN

YEARS.

419A.

(A) EVERY PERSON WHO SOLICITS. CAUSES, INDUCES, OR
KNOWINGLY PERMITS A PERSON UNDER 16 YEARS OF AGE TO ENGAGE
AS A SUBJECT IN THE PRODUCTION OF OBSCENE MATTER IS SUBJECT
TO THE PENALTY PROVIDED IN SUBSECTION (C).

(B) EVERY PERSON WHO PHOTOGRAPHS OR FILMS A PERSON
UNDER 16 YEARS OF AGE ENGAGING IN AN OBSCENE ACT IS SUBJECT
TO THE PENALTY PROVIDED IN SUBSECTION (C).

(C) EVERY PERSON WHO VIOLATES THE PROVISIONS OF THIS

SECTION IS GUILTY OF A FELONY AND UPON CONVICTION SHALL BE

FINED NOT MORE THAN $15,000 OR IMPRISONED FOR 10 YEARS, OR
BOTH IN THE DISCRETION OF THE COURT.

424.

Violation of this subtitle is punishable upon
conviction by fine of not to exceed [one thousand dollars
($1,000.00)] $1,000 or by imprisonment for not to exceed one
year, or both UNLESS OTHERWISE PROVIDED. Any subsequent
conviction of a violation of this subtitle is punishable by
a fine of not to exceed [five thousand dollars ($5,000.00)]
$5,000 or by imprisonment for not to exceed three years, or
both UNLESS OTHERWISE PROVIDED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
