assist their own law enforcement agencies in a strict
enforcement of their own laws and regulations, by sending
employees, agents, and representatives into Maryland to
conduct organized and systematic surveillance upon lawful
and properly regulated private business enterprises in
Maryland.

The offending agents note the presence and the
purchases of lawful customers and patrons presumed to be
from their own states, and sometimes pursue the customers
and patrons back into the home state in attempting to make
an arrest; and the resulting intimidation and harassment
impede and interfere with the right of citizens of the
United States to move freely and without fear across State
boundaries, and in the process to conduct business and
commerce in adjoining states.

The presence of these agents and their persistent
vigils outside lawful places of business and commerce in
Maryland is a constant affront also to the citizens of
Maryland, in their right to be secure in their persons and
property, without the constant potential of annoyance and
possible violence to themselves and to their business and
commercial activities.

While continuing to extend to the agents of sister
states the privilege of crossing its borders for law
enforcement purposes, the State of Maryland, in protection
of its citizens, residents, and lawful business and
commercial enterprises, as well as for the protection of the
citizens of other states while in Maryland, must institute a
system of registration for those engaged in surveillance
activities in this State, in order to know the purpose and
the location of their visitations and properly to protect
the peace of mind and safety of customers of our lawful
business and commercial enterprises, as well as to avoid
public brawls and possible violence; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 56 - Licenses

SURVEILLANCE

366.

(A) IN ORDER TO PRESERVE, PROMOTE, AND PROTECT THE
PUBLIC SAFETY AND THE PEACE OF THE COMMUNITY THROUGHOUT THE
STATE OF MARYLAND, BECAUSE OF THE PRESENCE IN THIS STATE OF
PERSONS ENGAGED IN THE ENFORCEMENT OF THE LAWS OF OTHER
STATES OR OF THE DISTRICT OF COLUMBIA, ANY AGENT, EMPLOYEE,
OR REPRESENTATIVE OF ANOTHER STATE OR THE DISTRICT OF
COLUMBIA, OR OF ANY POLITICAL SUBDIVISION THEREOF, MUST
REGISTER WITH THE OFFICE OF THE SHERIFF IN ANY MARYLAND
COUNTY (INCLUDING BALTIMORE CITY) THE LAW ENFORCEMENT AGENCY
DESIGNATED BY THE GOVERNING BODY OF THE COUNTY OR BALTIMORE
