REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77A, §28(a)
- except the first sentence — (b), and (c).

As to subsection (b) (1) of this section, the
terms of the members serving as of July 1, 1978
expire as follows: two in 1979, two in 1980,
three in 1981, two in 1982, and two in 1983.

In subsection (b) of this section, new language
is added to indicate that a member serves until a
successor takes office. In subsection (b)(2) of
this section, new language is added to clarify
that a vacancy in an unexpired term is filled
only for the remainder of that term. These
changes conform to similar provisions appearing
elsewhere in the Code.

12-103- CHAIRMAN AND OTHER OFFICERS; MEETINGS.

(A)   OFFICERS.

EACH YEAR, THE STATE BOARD FOR HIGHER EDUCATION SHALL
ELECT FROM AMONG ITS MEMBERS:

(1)   A CHAIRMAN; AND

(2)   ANY OTHER OFFICER IT REQUIRES.

(B)   MEETINGS.

THE BOARD SHALL SET THE TIME AND PLACE OF ITS MEETINGS
AND MAY ADOPT RULES FOR THE CONDUCT OF ITS MEETINGS.

REVISOR'S NOTE: Subsection (a) of this section
presently appears as Art. 77A, §28(d).

The present requirement that the Governor
designate a temporary chairman is deleted as
obsolete.

Subsection (b) of this section is new language
added to set out the authority of the Board to
meet.

12-104. STAFF OF BOARD.

(A) COMMISSIONER OF HIGHER EDUCATION.

(1)   THE STATE BOARD FOR HIGHER EDUCATION SHALL
APPOINT A COMMISSIONER OF HIGHER EDUCATION.

(2)    THE COMMISSIONER IS THE EXECUTIVE HEAD OF
THE STAFF OF THE BOARD.
