SUBTITLE 1. IN GENERAL.

12-101. BOARD ESTABLISHED.

THERE IS A STATE BOARD FOR HIGHER EDUCATION.

REVISOR'S NOTE: This section presently appears as the
first sentence of Art. 77A, §28(a).

It is set forth as a separate section for
emphasis.

No changes have been made.

12-102. COMPOSITION; TERM; VACANCIES; COMPENSATION.

(A)   COMPOSITION.

THE STATE BOARD FOR HIGHER EDUCATION CONSISTS OF 11
MEMBERS APPOINTED BY THE GOVERNOR WITH THE ADVICE AND
CONSENT OF THE SENATE.

(B)   TERM AND VACANCIES.

(1)    EACH MEMBER OF THE BOARD SERVES FOR A TERM
OF 5 YEARS AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.
THESE TERMS ARE STAGGERED AS REQUIRED BY THE TERMS OF THE
MEMBERS SERVING ON THE BOARD AS OF JULY 1, 1978.

(2)    A MEMBER APPOINTED TO FILL A VACANCY IN AN
UNEXPIRED TERM SERVES ONLY FOR THE REMAINDER OF THAT TERM
AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(3)    A MEMBER MAY BE REAPPOINTED BUT MAY NOT
SERVE MORE THAN TWO FULL 5-YEAR TERMS.

(C)    COMPENSATION.

EACH MEMBER OF THE BOARD:

(1)   SERVES WITHOUT COMPENSATION; AND

(2)   IS ENTITLED TO REIMBURSEMENT FOR EXPENSES IN
ACCORDANCE WITH THE STANDARD STATE TRAVEL REGULATIONS.

(D)   RESTRICTION ON OUTSIDE ACTIVITIES.

DURING HIS MEMBERSHIP ON THE BOARD, A MEMBER MAY NOT BE
EMPLOYED BY OR BE A MEMBER OF THE GOVERNING OR ADVISORY
BOARD OF ANY AGENCY OR ANY INSTITUTION OF POSTSECONDARY
EDUCATION THAT IS SUBJECT TO THE JURISDICTION OF THE BOARD.
