(1) THE COMMISSIONER SHALL:

(I)   PERFORM THE DUTIES THE BOARD ASSIGNS; AND

(II) SEE THAT THE POLICIES OF THE BOARD ARE
CARRIED OUT.

(2)    THE COMMISSIONER SERVES FOR A TERM OF 4
YEARS, AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES. HE
MAY BE REAPPOINTED.

(3)   THE COMMISSIONER MAY BE REMOVED BY THE BOARD
FOR GOOD CAUSE ON CHARGES FILED BY THE BOARD AND AFTER A
HEARING.

(4)    THE COMMISSIONER SHALL BE A MEMBER OF THE
GOVERNOR'S EXECUTIVE COUNCIL.

(5)   THE COMMISSIONER IS ENTITLED TO THE SALARY
PROVIDED IN THE STATE BUDGET.

(C)   ADDITIONAL STAFF.

THE BOARD MAY HAVE THE ADDITIONAL STAFF PROVIDED IN THE

STATE BUDGET.

(D)   MEMBERSHIP IN RETIREMENT SYSTEM.

EACH EMPLOYEE OF THE BOARD SHALL JOIN THE STATE
TEACHERS' RETIREMENT SYSTEM OR THE STATE EMPLOYEES'
RETIREMENT SYSTEM. HOWEVER, AS AN ALTERNATIVE ANY EMPLOYEE
IN A POSITION DETERMINED BY THE BOARD TO BE A PROFESSIONAL
POSITION MAY JOIN THE OPTIONAL RETIREMENT PROGRAM UNDER
ARTICLE 73B, §110 OF THE CODE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77A, §29.

As to the State Employees' Retirement System, the
Teachers' Retirement System, and the Optional
Retirement Program, see Art. 73B of the Code.

12-105. GENERAL POWERS AND DUTIES OF BOARD.

(A)   IN GENERAL.

IN ADDITION TO ANY OTHER POWERS GRANTED AND DUTIES
IMPOSED BY THIS TITLE AND SUBJECT TO ANY RESTRICTIONS
IMPOSED BY LAW, THE STATE BOARD FOR HIGHER EDUCATION HAS THE
POWERS AND DUTIES SET FORTH IN THIS SECTION.

REVISOR'S NOTE: This subsection is new language added
to indicate clearly that the powers and duties
enumerated in this section are not exclusive.

(B)   COORDINATION.
