IN THE PRACTICE OF OCCUPATIONAL THERAPY.

(B) THIS SUBTITLE SHALL NOT BE CONSTRUED TO PREVENT

AN INDIVIDUAL LICENSEE AS A PHYSICAL THERAPIST OR PHYSICAL

THERAPIST ASSISTANT FROM THE DESIGN, FABRICATION, AND USE OF

SPLINTS AND ADAPTIVE EQUIPMENT; DEVELOPMENTAL,

PERCEPTUAL-MOTOR AND SENSORY INTEGRATIVE ACTIVITIES:

ACTIVITIES OF DAILY LIVING: AND CONSULTATION CONCERNING THE

ADAPTATION OF ENVIRONMENTS FOR THE HANDICAPPED, WITHIN THE

SCOPE OF THEIR PROFESSIONAL COMPETENCE, IF THEY DO NOT HOLD

THEMSELVES OUT BY ANY TITLE OR DESCRIPTION OF SERVICES AS

BEING ENGAGED IN THE PRACTICE OF OCCUPATIONAL THERAPY.

(2) ORTHOTISTS (C) THIS SUBTITLE DOES NOT
AFFECT THE PRACTICE, SERVICES, OR ACTIVITIES OF ORTHOTISTS
AND PROSTHETISTS FROM FITTING, MANUFACTURING, AND APPLYING
SPLINTS OR OTHER ORTHOTIC DEVICES, WHILE PRACTICING WITHIN
THE STANDARDS AND ETHICS OF THEIR PROFESSION IF THEY DO NOT
HOLD THEMSELVES OUT BY ANY TITLE OR DESCRIPTION OF SERVICES
AS BEING ENGAGED IN THE PRACTICE OF OCCUPATIONAL THERAPY.

913. BOARD ESTABLISHED.

THERE IS A BOARD OF OCCUPATIONAL THERAPY PRACTICE IN
THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE.

914.  MEMBERSHIP.

(A) COMPOSITION.

(1)    THE BOARD CONSISTS OF FIVE MEMBERS EACH
APPOINTED BY THE GOVERNOR ON THE RECOMMENDATION OF THE
SECRETARY OF HEALTH AND MENTAL HYGIENE FROM A LIST OF

NOMINEES PRESENTED BY THE MARYLAND OCCUPATIONAL THERAPY

ASSOCIATION.

(2)    OF THE FIVE BOARD MEMBERS:

(I)    THREE SHALL BE LICENSED OCCUPATIONAL

THERAPISTS;

(II)   ONE SHALL BE A LICENSED OCCUPATIONAL
THERAPY ASSISTANT; AND

(III)  ONE SHALL BE A PUBLIC MEMBER WHO IS
NOT AN OCCUPATIONAL THERAPIST OR OCCUPATIONAL THERAPY
ASSISTANT.

(3) THE SECRETARY OF HEALTH AND MENTAL HYGIENE

SHALL MAKE HIS RECOMMENDATION FOR THE OCCUPATIONAL THERAPIST
AND OCCUPATIONAL THERAPY ASSISTANT MEMBERS FROM A LIST OF

NAMES SUBMITTED TO THE SECRETARY BY THE ASSOCIATION. THE

LIST SHALL CONTAIN THE NUMBER OF NAMES THAT IS THREE TIMES
THE NUMBER OF VACANCIES.

(E) EXEMPTION FOR MEMBERS OF THE ORIGINAL BOARD.

FOR ONE YEAR FROM APPOINTMENT TO THE BOARD, THE
