FOR the purpose of requiring certain constables to be paid
on the same salary scale as not less than certain
deputy sheriffs in the same jurisdiction on the same
salary scale as certain deputy sheriffs.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

2-604.

(b) Constables may serve either full time or part
time. EXCEPT WITH REGARD TO SALARY, [Full-time] FULL-TIME
constables are in the classified service AND SHALL BE PAID
ON THE SAME SALARY SCALE AS THAT SET BY THE SECRETARY OF
PERSONNEL PURSUANT TO § 2-309 (D) OF THIS ARTICLE FOR BE PAID
ON THE SAME SALARY SCALE AS FULL-TIME DEPUTY SHERIFFS IN THE
COUNTY. NOT BE PAID LESS THAN FULL-TIME DEPUTY SHERIFFS IN
THAT COUNTY OR BALTIMORE CITY. Part-time constables are not
in the classified service, and are paid the compensation
prescribed by the General Assembly, and serve at the
pleasure of the Chief Judge of the District Court.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
