AN ACT concerning

Mental Health Emergency Admissions -
Geriatric Evaluation Unit

FOR the purpose of exempting certain persons who are
proposed for admission to a mental health facility
pursuant to certain admissions procedures from the
requirement that their admission he recommended by a
geriatric evaluation unit; and providing for
notification of certain geriatric evaluation units
under certain circumstances.

BY repealing and reenacting, with amendments,

Article 59 - Mental Hygiene

Section 11(b)(2)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 59 — Mental Hygiene

(b) (2) On or after July 1, 1977, persons 65 years
of age and older may be involuntarily or voluntarily
admitted to a facility only if their admission is
recommended by a geriatric evaluation unit. HOWEVER, ANY
PERSONS PERSON ADMITTED TO A FACILITY PURSUANT TO THE
PROVISIONS OF SECTION 22 OF THIS ARTICLE DOES NOT HAVE TO
HAVE THEIR MAY BE ADMITTED WITHOUT HIS ADMISSION RECOMMENDED
BY A GERIATRIC EVALUATION UNIT. WHEN AN EMERGENCY ADMISSION

OF A PERSON 65 YEARS OF AGE OR OLDER HAS TAKEN PLACE, THE

GERIATRIC___EVALUATION UNIT OF THE POLITICAL SUBDIVISION OF

THE PERSON'S___RESIDENCE SHALL BE INFORMED ON THE FIRST

WORKING DAY THEREAFTER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
