AN ACT concerning

Common Carrier — Seafood Transporting

FOR the purpose of exempting transporters of seafood from
fines or penalties for the transportation of unlawfully
caught or unlawfully sized seafood.

BY adding to

Article - Natural Resources
Section 4-1201(d)
Annotated Code of Maryland
(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

4-1201.

(D)         A COMMON FREIGHT HAULER OF CARRIER TRANSPORTING

FISH WHO IS NOT THE BUYER, SELLER, OR CATCHER OF THE FISH OR

IS NOT CONTROLLED BY THE BUYER, SELLER, OR CATCHER OF THE

FISH IS NOT SUBJECT TO ANY PENALTY UNDER THIS SECTION FOR
TRANSPORTING FISH WHICH IS EITHER UNLAWFULLY CAUGHT OR OF

UNLAWFUL SIZE PROVIDED___THAT THE OPERATOR OF THE COMMON

CARRIER HAS IN HIS POSSESSION A VALID BILL OF LADING.

STATING THE ORIGIN, SHIPPER, DESTINATION AND RECEIVER OF THE
FISH AND THE COMMON CARRIER DOES NOT KNOW OR HAVE REASON TO

KNOW THAT THE FISH WERE UNLAWFULLY CAUGHT OR OF UNLAWFUL

SIZE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
