SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 77 - Public Education
160-
(a) (3) "Public school employee" means any
certificated professional person employed by a public school
employer, or any person of equivalent status in Baltimore
City so employed, except the superintendent of schools and
persons designated by the public school employer to act in a
negotiating capacity as specified in subsection (h) (1) of
this section. IN MONTGOMERY COUNTY, PUBLIC SCHOOL EMPLOYEES
INCLUDE CERTIFICATED AND NONCERTIFICATED SUBSTITUTE TEACHERS
EMPLOYED BY THE PUBLIC SCHOOL EMPLOYER FOR AT LEAST 7 DAYS
PRIOR TO BEFORE MARCH 1 OF THE SCHOOL FISCAL YEAR ENDING
JUNE 30, 1978, AND EVERY EACH YEAR THEREAFTER AFTER.
(g) An employee organization designated as an
exclusive representative shall serve as the negotiating
agent of all public school employees in the unit in such
county or Baltimore City. An employee organization
designated as exclusive representative of the employees in a
unit must represent fairly and without discrimination all
employees in the unit without regard to whether such
employees are members of such employee organization. IN
ADDITION, IN MONTGOMERY COUNTY THE EXCLUSIVE REPRESENTATIVE
SHALL REPRESENT FAIRLY AND WITHOUT DISCRIMINATION ALL
PERSONS ACTUALLY EMPLOYED AS SUBSTITUTE TEACHERS WITHOUT
REGARD TO WHETHER THEY ARE INCLUDED IN PARAGRAPH (A) (3) OF
THIS SECTION AS PUBLIC SCHOOL EMPLOYEES.
(h) (1) A public school employer, or such
representatives as it may designate, who shall not be less
than two in number, shall meet and negotiate with two or
more representatives of the employee organization so
designated as the exclusive negotiating agent for the public
school employees in a unit of said county or Baltimore City,
