relating to Somerset County is to enlarge the membership of
the existing commission to five members to more effectively
carry out the provisions of this subtitle, and neither these
provisions or the action of the said governing body in
appointing two additional members provided for herein shall
be construed to alter, abrogate, change, or affect in any
way any contract, agreement, obligation, commitment or
undertaking to which the commission is now a party, or in
which the commission is presently engaged.
(IV) AS OF JULY 1, 1978, ONE MEMBER OF THE
SOMERSET COUNTY SANITARY COMMISSION SHALL BE A RESIDENT OF
EACH SANITARY SUBDISTRICT WITHIN THE COUNTY. IF AT ANY TIME
MORE THAN FIVE SUBDISTRICTS ARE ESTABLISHED WITHIN THE
COUNTY, THE SANITARY COMMISSION SHALL BE ENLARGED SO THAT
THERE SHALL BE ONE MEMBER FROM EACH SUBDISTRICT.
THEREAFTER, WHENEVER A NEW SANITARY SUBDISTRICT IS
ESTABLISHED, THE SANITARY COMMISSION SHALL BE ENLARGED TO
INCLUDE ONE MEMBER FROM EACH NEW SUBDISTRICT. WHENEVER THIS
PROCEDURE WOULD RESULT IN AN EVEN NUMBER OF MEMBERS ON THE
SANITARY COMMISSION, AN ADDITIONAL MEMBER SHALL BE APPOINTED
AT LARGE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
does not require that any member of the present Sanitary
Commission be replaced before the expiration of any current
term. The purposes of this Bill may be accomplished by
appointments made as members' current terms expire.
SECTION 3. AND BE IT FURTHER ENACTED, That the only
purpose for requiring an odd number of members on the
Sanitary Commission is to preclude the possibility of a tie
vote.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
