UNSATISFACTORY THE EMPLOYEE SHALL BE REMOVED FROM THE NEW
POSITION AND REINSTATED TO THE POSITION FROM WHICH PROMOTED.
He may be removed by the Commissioner of Personnel, upon
charges filed by the Director and upon proof of
inefficiency, neglect of duty, misconduct in office, or
other cause. Before he is removed from his position he
shall be given a copy of the charges against him and an
opportunity of being heard publicly in person or by counsel
in his defense, upon not less than ten days' notice.

(C)         THE LEGISLATIVE AUDITOR SHALL APPOINT, SUBJECT TO

THE APPROVAL OF THE DIRECTOR OF THE DEPARTMENT, A DEPUTY
LEGISLATIVE AUDITOR. THE DEPUTY AUDITOR SHALL HOLD A VALID
UNREVOKED CERTIFICATE TO PRACTICE AS A CERTIFIED PUBLIC
ACCOUNTANT, ISSUED UNDER THE AUTHORITY OF THE STATE OF
MARYLAND. THE DEPUTY AUDITOR SHALL BE A FULL-TIME EMPLOYEE
OF THE DIVISION OF AUDITS AND SHALL PERFORM DAY TO DAY
DUTIES AND HAVE RESPONSIBILITIES AS ASSIGNED BY THE
LEGISLATIVE AUDITOR. IN THE EVENT OF THE INCAPACITY OR

ABSENCE OF THE LEGISLATIVE AUDITOR THE DIRECTOR OF THE
DEPARTMENT MAY DESIGNATE THE DEPUTY AUDITOR TO ACT IN THE
CAPACITY OF THE LEGISLATIVE AUDITOR.        THE DEPUTY AUDITOR

SHALL HOLD THAT POSITION IN ACCORDANCE WITH THE CONDITIONS
GOVERNING OTHER PROFESSIONAL EMPLOYEES OF THE DEPARTMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1978.
