shall take effect July 1, 1978.

(House Bill 1014)

AN ACT concerning

Department of Fiscal Services — Employees

FOR the purpose of requiring that employees of the
Department of Fiscal Services, when promoted, serve a
probationary period in their new positions; and
authorizing appointment of the Deputy Legislative
Auditor and specifying his qualifications, powers,
duties and tenure.

BY repealing and reenacting, with amendments,

Article 40 — General Assembly

Section 59 (d)

Annotated Code of Maryland

BY adding to

Article 40 — General Assembly

Section 61A(c)

Annotated Code of Maryland

(1971 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 40 — General Assembly

59.

(d) Other professional employees in the Department
shall be appointed by the respective executive heads of the
Divisions, subject to the approval of the Director.
Initially, each shall hold his position on probationary
status for one year, subject during that period to dismissal
by the Director. Thereafter, each of the other professional
employees shall hold his position indefinitely. WHEN
PROMOTED, AN EMPLOYEE SHALL HOLD THE NEW POSITION ON
PROBATIONARY STATUS FOR NOT LONGER THAN ONE YEAR. IF DURING
THE PROBATIONARY PERIOD THE DIRECTOR DETERMINES THAT THE
EMPLOYEE'S PERFORMANCE IN THE NEW POSITION IS
