SECTION 3. AND BE IT FURTHER ENACTED, That Section(s)
11(1) (b)(1) through (4), inclusive, (3) (e) (4), (11) (c) ,
(14), (15), (16), (16a), (18), and (20), respectively, of
Article 73B - Pensions, of the Annotated Code of Maryland be
renumbered to be Section(s) 11(1) (b) (i) through (iv) ,
inclusive, (3) (b) (iv), (11)(b), (15), (16), (17), (18),
(19), and (21), respectively.

SECTION 4. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Article 73 - Pensions

11.

(9) (C) THE SURVIVING SPOUSE OF A MEMBER WHO DIES
IN SERVICE MAY ELECT TO RECEIVE, IN LIEU OF THE LUMP SUM
BENEFIT PAYABLE UNDER PARAGRAPH (A) OF THIS SUBSECTION, A
MONTHLY ALLOWANCE FOR LIFE EQUAL TO THE AMOUNT PAYABLE UNDER
OPTION 2, IF:

(I)    THE SPOUSE IS NAMED AS THE SOLE
PRIMARY BENEFICIARY; AND

(II)   THE MEMBER:

(A) WAS ELIGIBLE TO RETIRE; OR

(B) HAD AT LEAST 15 YEARS OF
CREDITABLE SERVICE AND WAS 55 YEARS OLD OR OLDER.

(14) A PERSON APPOINTED OR ELECTED TO THE GENERAL
ASSEMBLY ON OR AFTER JANUARY 1, 1971 MAY PARTICIPATE IN THE
PENSION PLAN PROVIDED IN RESOLUTION OF THE GENERAL ASSEMBLY
COMPENSATION COMMISSION UNDER ARTICLE 40 OF THE CODE.

SECTION 5. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
