AN ACT concerning

Adequate Public Facilities Ordinances

FOR the purpose of authorizing certain counties and
municipalities the power to enact adequate public
facilities ordinances.

BY adding to

Article 66B - Zoning and Planning

Section 10.01 to be under the new subtitle "Adequate

Public Facilities Ordinances"
Annotated Code of Maryland
(1970 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 66B — Zoning and Planning

ADEQUATE PUBLIC FACILITIES ORDINANCES

10.01.

IN ORDER TO FACILITATE ORDERLY DEVELOPMENT AND GROWTH
ANY COUNTY AND ANY MUNICIPALITY WITH PLANNING AND ZONING
AUTHORITY MAY ENACT ORDINANCES REQUIRING THE PLANNING,

STAGING OR PROVISION OF ADEQUATE PUBLIC FACILITIES PRIOR TO

DEVELOPMENT. ADEQUATE FACILITIES MEANS THE PROVISION AND

STAGING OF CERTAIN NECESSARY ADJUNCTS TO DEVELOPMENT,

INCLUDING, BUT NOT LIMITED TO SEWERAGE, WATER, SOLID WASTE

DISPOSAL, TRANSPORTATION, AND EDUCATIONAL FACILITIES. THIS
AUTHORITY IS IN ADDITION TO ANY EXISTING PLANNING AND ZONING
POWERS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
