AN ACT concerning

Baltimore City — Zoning

FOR the purpose of clarifying the authority of the Board of
Zoning Appeals to hear and decide special exceptions
and the authority of the Mayor and City Council of
Baltimore to grant variances, special exceptions and
conditional uses by ordinance.

BY repealing and reenacting, with amendments,

Article 66B - Zoning and Planning

Section 2.08(c)

Annotated Code of Maryland

(1970 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 66B — Zoning and Planning

2.08.

(c) The board of zoning appeals shall have the
following powers:

(1)    To hear and decide appeals where it is
alleged there is an error in any order, requirement,
decision, or determination made by an administrative
official in the enforcement of this article or of any
ordinance adopted pursuant thereto.

(2)    To hear and decide special exceptions to
the terms of the ordinance upon which such board is required
to pass under such ordinance. NOTHING IN THIS SECTION SHALL
BE CONSTRUED TO PREVENT THE MAYOR AND CITY COUNCIL OF
BALTIMORE FROM GRANTING VARIANCES, SPECIAL EXCEPTIONS, OR
CONDITIONAL USES BY ORDINANCE, WHEN SO AUTHORIZED BY THE
GENERAL ZONING ORDINANCE OF BALTIMORE CITY.

(3)    To authorize upon appeal in specific cases
a variance from the terns of the ordinance.

(4)    To approve buildings, and uses limited as
to location under such rules and regulations as may be
