by proxy with respect to Bylaw Amendments by
condominium unit owners.

BY repealing and reenacting, with amendments,

Section 11-104(e)

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Real Property

1 1-104.

(e) (1) The bylaws may be amended by the
affirmative vote of unit owners having [75] 66 2/3 75
percent or more of the votes. Each particular set forth in
subsection (b) shall be expressed in the bylaws as amended.
An amendment shall be entitled to be recorded if accompanied
by a certificate of the person specified in the bylaws to
count votes at the meeting of the council of unit owners
that the amendment was approved by unit owners having at
least [7 5] 66 2/3 75 percent of the votes and shall be
effective on recordation. This certificate shall be
conclusive evidence of approval.

(2) (I) UNLESS THE BYLAWS PROVIDE OTHERWISE,
A UNIT OWNER MAY VOTE IN PERSON OR BY WRITTEN PROXY SIGNED
BY THE UNIT OWNER.

(II) A PROXY IS NOT VALID MORE THAN 30 180
90 DAYS AFTER ITS DATE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
