AND MAINTAIN A MONTHLY LIST OF ALL PERSONS FOUND BY THE

NATIONAL LABOR RELATIONS BOARD TO HAVE WILLFULLY ENGAGED IN

OR TO BE WILLFULLY ENGAGING IN UNFAIR LABOR PRACTICES IN

CONTEMPT OF COURT BY A FEDERAL COURT OF APPEALS FOR FAILURE
TO CORRECT AN UNFAIR LABOR PRACTICE PROHIBITED BY THE
NATIONAL LABOR RELATIONS ACT (29 U.S.C. § 158, 49 STAT.
452). THIS LIST SHALL CONTAIN THE NAMES OF THOSE PERSONS
FOUND TO HAVE ENGAGED IN THESE PRACTICES DURING THE 3 2-YEAR
PERIOD BEFORE THE DATE OF THE LIST.

(B) A PUBLIC WORKS, SERVICE, OR SUPPLY CONTRACT     OR

SUBCONTRACT MAY NOT BE AWARDED TO ANY SUPPLIER OR FOR    ANY

GOODS MANUFACTURED BY A COMPANY WHOSE NAME APPEARS ON     THE
MOST RECENT LIST OF THE SECRETARY.

(C) ANY PERSON WHOSE NAME IS CONTAINED ON THE LIST

AND WHO ACCEPTS A CONTRACT OR SUBCONTRACT PROHIBITED BY THIS

SECTION IS GUILTY OF A MISDEMEANOR AND UPON CONVICTION IS

SUBJECT TO IMPRISONMENT NOT EXCEEDING 6 MONTHS OR A FINE NOT

EXCEEDING $10,000 OR BOTH.

(C) THIS RESTRICTION DOES NOT PROHIBIT THE AWARDING

OF A CONTRACT TO A COMPANY WHOSE NAME DOES NOT APPEAR ON

SUCH A LIST BUT WHOSE GOODS MANUFACTURED INCLUDE COMPONENT

PARTS MANUFACTURED BY A COMPANY WHOSE NAME DOES APPEAR ON

THE LIST.

(D) THIS RESTRICTION DOES NOT APPLY DURING AN

EMERGENCY SITUATION WHEN THE LISTED PERSON IS THE SOLE

SOURCE OF SUPPLY FOR THE GOODS OR SERVICES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Blind Industries and Services of Maryland — Payment
Board of Trustees

FOR the purpose of requiring the promulgation of regulations
relating to the powers of the Board of Trustees of the
Blind Industries and Services of Maryland; and deleting
certain archaic references to blind or colored deaf

persons. FOR the purpose of correcting an erroneous

statutory reference to the governing body of the Blind
Industries and Services of Maryland.
