Section 11-111 and 15-101(b) (1) and (2) (ii)

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

(b) (3) "DEALER" INCLUDES A PERSON WHO, DURING ANY

12-MONTH PERIOD, SELLS TO RETAIL BUYERS IN THIS STATE FIVE

OR MORE VEHICLES OF A TYPE REQUIRED TO BE REGISTERED UNDER

TITLE 13 OF THIS ARTICLE.

"Dealer" means a person who is in the business of
buying, selling, or exchanging vehicles INCLUDING A PERSON
WHO DURING ANY 12 MONTH PERIOD SELLS FIVE OR MORE VEHICLES,
THE OWNERSHIP OF WHICH WAS ACQUIRED FOR RESALE PURPOSES.

(b) (1) (I) "Dealer" means, except as provided in

paragraph (2)__of this subsection a dealer in vehicles of a

type required to be registered under Title 13 of this

article INCLUDING A PERSON WHO DURING ANY 12 MONTH PERIOD

SELLS FIVE OR MORE VEHICLES, THE OWNERSHIP OF WHICH WAS

ACQUIRED FOR RESALE PURPOSES.

(II) FOR THE PURPOSES OF SECTIONS 15-207

THROUGH 15-213 INCLUSIVE OF THIS TITLE, RELATING TO THE

RIGHTS,__SAFEGUARDS AND PROTECTIONS AFFORDED DEALERS,

"DEALER" INCLUDES A DISTRIBUTOR WHO HOLDS A FRANCHISE FROM A
MANUFACTURER OR FACTORY BRANCH.

(2) "Dealer" does not include:

(ii) An insurance company, finance

company, tank, or other lending institution licensed or

otherwise authorized to do business in this State that, to

save it from loss, sells or disposes of vehicles under a

contractual right and in the regular course of its business;

OR A LICENSED AUCTIONEER ACTING__ON BEHALF OF A SELLER,

SECURED PARTY OR OWNER AND WHERE TITLE DOES NOT PASS TO THE
AUCTIONEER AND THE AUCTION IS NOT FOR THE PURPOSE OF

AVOIDING THE PROVISIONS OF THIS TITLE.
