(2)    CONVICTION OF ANY CRIMINAL OFFENSE THE
EFFECT OF WHICH IS TO PREVENT OR INTERFERE WITH THE
PERFORMANCE OF ANY DUTY OF THE BOARD;

(3)    FAILURE TO CARRY OUT DUTIES ASSIGNED BY THE

BOARD OR ITS CHAIRMAN; OR

(4)    ACCEPTANCE OF ANY POSITION OR THE CONDUCT
OF ANY BUSINESS THAT CONFLICTS OR TENDS TO CONFLICT WITH THE
PERFORMANCE OF ANY DUTY OF THE BOARD.

(A)    THE BOARD OR ONE MEMBER OF THE BOARD AS

DESIGNATED BY THE CHAIRMAN SHALL HEAR AND DETERMINE ALL

DISPUTES WITHIN ITS JURISDICTION.

(B)    THE BOARD SHALL HAVE JURISDICTION OVER ALL
DISPUTES OTHER THAN LABOR DISPUTES ARISING UNDER A CONTRACT
WITH THE DEPARTMENT, OR AS A RESULT OF A BREACH OF A
CONTRACT WITH THE DEPARTMENT. THE BOARD HAS NO JURISDICTION
OVER THE AWARDING OF A CONTRACT WITH THE DEPARTMENT.

(C)    THE BOARD SHALL ISSUE A FINAL DECISION IN WRITING
ON EACH DISPUTE SUBMITTED. A COPY OF THE DECISION SHALL BE
DELIVERED OR MAILED TO THE SECRETARY AND TO EACH PARTY TO
THE DISPUTE.

(D)    THE BOARD SHALL ADOPT RULES AND REGULATIONS WHICH
PROVIDE. TO THE FULLEST EXTENT POSSIBLE, INFORMAL,
EXPEDITIOUS, AND INEXPENSIVE RESOLUTION OF CLAIMS AND
CONTROVERSIES.

(E) A BOARD MEMBER MAY NOT PARTICIPATE IN ANY
DETERMINATION OR VOTE IN ANY PROCEEDING IN WHICH THE MEMBER
HAS A DIRECT OR INDIRECT PRIVATE INTEREST.

2-604.

THE ADMINISTRATIVE PROCEDURE ACT SHALL NOT APPLY TO
PROCEEDINGS UNDER THIS SUBTITLE, EXCEPT FOR THE ADOPTION OF
RULES AND REGULATIONS BY THE BOARD.

(A) AN AGGRIEVED PARTY, INCLUDING THE DEPARTMENT, MAY

APPEAL A FINAL DECISION OR PART THEREOF, TO THE CIRCUIT

COURT FOR ANNE ARUNDEL COUNTY, TO THE CIRCUIT COURT OR THE

BALTIMORE CITY COURT, AS THE CASE MAY BE, WHERE THE PARTY

RESIDES OR HAS ITS PRINCIPAL PLACE OF BUSINESS, PROVIDED

THAT NOTICE OF THE APPEAL IS FILED WITHIN 12 MONTHS AFTER

THE DATE OF RECEIPT OF A COPY OF THE BOARD'S FINAL DECISION.

       (B) (1) IN THE EVENT OF AN APPEAL, NOTWITHSTANDING

ANY CONTRACT PROVISION, REGULATION OR RULE OF LAW TO THE

CONTRARY, NO DECISION BY THE BOARD ON A QUESTION OF LAW

SHALL BE FINAL OR CONCLUSIVE.__
