SUBTITLE 6. BOARD OF CONTRACT APPEALS
2-601.

THERE IS A BOARD OF CONTRACT APPEALS OF THE DEPARTMENT.
2-602.

(A)     (1) THE BOARD CONSISTS OF THREE MEMBERS, EACH
APPOINTED BY THE GOVERNOR ON THE RECOMMENDATION OF THE
SECRETARY AND WITH THE ADVICE AND CONSENT OF THE SENATE.

TWO OF THE THREE MEMBERS SHALL SERVE ONLY ON A PART-TIME

BASIS.

(2) IF A MEMBER IS UNABLE TO SERVE, THE
GOVERNOR MAY APPOINT AN ALTERNATE TO SERVE IN HIS ABSENCE.

(B)    OF THE THREE BOARD MEMBERS, ONE SHALL BE AN

ATTORNEY ADMITTED TO PRACTICE LAW IN THE STATE.

(C)     (1) THE TERM OF A MEMBER IS THREE YEARS.

(2)    AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(3)    A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTEE AND QUALIFIES.

(4)    A MEMBER MAY BE REAPPOINTED.

(D)    THE GOVERNOR SHALL DESIGNATE ONE OF THE MEMBERS

WHO IS AN ATTORNEY AS THE ATTORNEY MEMBER TO SERVE AS THE
FULL-TIME CHAIRMAN OF THE BOARD.

(E)    THE BOARD IS ENTITLED TO THE STAFF PROVIDED IN
THE STATE BUDGET.

(F)    EACH MEMBER OF THE BOARD IS ENTITLED TO:

(1)    COMPENSATION IN ACCORDANCE WITH THE STATE
BUDGET; AND

[2)     REIMBURSEMENT FOR EXPENSES UNDER THE
STANDARD STATE TRAVEL REGULATIONS.

(G)    ON RECOMMENDATION OF THE SECRETARY, THE GOVERNOR
MAY REMOVE ANY MEMBER OF THE BOARD FOR ANY OF THE FOLLOWING
REASONS:

(1) CONVICTION OF ANY CRIME THAT INVOLVES MORAL
TURPITUDE;
