AN ACT concerning

Commission on Medical Discipline

FOR the purpose of redefining a certain ground under which
the Commission on Medical Discipline may take certain
actions against a physician.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

130.

(h) When the Commission has completed its
investigation according to the process outlined herein, it
may reprimand a physician or place him on probation, revoke
or suspend his license, or dismiss the charges against the
physician for any of the causes listed below as
unprofessional conduct:

[(6) Addiction to narcotics, habitual
drunkenness or rendering professional services to a patient
if the physician is intoxicated or under the influence of
drugs.]

(6) (I) IS ADDICTED TO THE ILLEGAL USE OF A
CONTROLLED DANGEROUS SUBSTANCE;

(II)   HABITUALLY ABUSES ANY NARCOTIC OR
CONTROLLED DANGEROUS SUBSTANCE AS DEFINED IN ARTICLE 27 OF
THE ANNOTATED CODE OF MARYLAND;

(III)  IS HABITUALLY INTOXICATED; OR

(IV) IS HABITUALLY UNDER THE INFLUENCE OF

ALCOHOL OR A CONTROLLED DANGEROUS SUBSTANCE; OR

(V) (IV) RENDERS PROFESSIONAL SERVICES
WHILE DRINKING ALCOHOLIC BEVERAGES OR UNDER THE INFLUENCE OF
