(House Bill 790)

AN ACT concerning

Criminal Law — Concealment of Medical Negligence

FOR the purpose of making it a misdemeanor for any
physician, surgeon, dentist, osteopath, podiatrist,
optometrist, chiropractor, or nurse, or any person
employed by or under contract with any hospital,
nursing institution, or other health provider to
knowingly or wilfully destroy, damage, obliterate, or
otherwise obscure a patient's medical record, hospital
record, laboratory report, x-ray report, or any other
data or information in an effort to conceal an act or

an omission of an act that constitutes medical

negligence such medical data or information as evidence

in an administrative, civil, or criminal proceeding;

and providing for certain penalties.

BY adding to

Article 27 — Crimes and Punishments

Section 275A, to be under the new subheading "Health —

Concealment of Medical Records"
Annotated Code of Maryland
(1976 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

HEALTH - CONCEALMENT OF MEDICAL RECORDS
