BY repealing and reenacting, with amendments,

Article 40 - General Assembly

Section 50

Annotated Code of Maryland

(1971 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 40 — General Assembly

50.

(a)    [The head of the State Department of Legislative
Reference shall be the State Board of Legislative Reference,
with five members, as follows: the President of the Senate
of Maryland, the Speaker of the House of Delegates of
Maryland, the Chief Judge of the Court of Appeals of
Maryland, the president of The Johns Hopkins University, and
the dean of the Law School of the University of Maryland.
The members of the Board shall serve without compensation.]
THE STATE DEPARTMENT OF LEGISLATIVE REFERENCE IS CREATED AND
CONTINUED, WITH THE POWERS, DUTIES, FUNCTIONS, AND OFFICERS
AND EMPLOYEES PROVIDED IN THIS SUBTITLE.

(b)    [The Board shall appoint a Director to conduct
the affairs of the Department.] THE DIRECTOR OF THE STATE
DEPARTMENT OF LEGISLATIVE REFERENCE IS THE EXECUTIVE HEAD OF
THE DEPARTMENT. HE SHALL BE APPOINTED JOINTLY BY THE
PRESIDENT OF THE SENATE AND THE SPEAKER OF THE HOUSE OF
DELEGATES AND SHALL HAVE GENERAL ADMINISTRATIVE CONTROL OVER
THE OPERATIONS AND FUNCTIONS OF THE DEPARTMENT. The Director
shall hold office [during good behavior] INDEFINITELY and
shall be subject to removal by the [Board, or by a majority
of the Board,] PRESIDENT AND THE SPEAKER [for incompetence]
UPON PROOF OF INEFFICIENCY, [or] NEGLECT OF DUTY, MISCONDUCT
IN OFFICE, OR OTHER CAUSE; but before any Director may be
removed from office he shall be given a copy of the charges
made against him and an opportunity of being publicly heard
in person or by counsel in his own defense, upon not less
than ten days' notice.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
may not be construed or applied to affect the appointment of
or to change any other laws as to the Director of the State
Department of Legislative Reference who is in office on the
effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
