CHAPTER 265

(Senate Bill 755)

AN ACT concerning

Fraudulent Medicaid Overpayments — Triple Damages

FOR the purpose of creating a certain penalty for any health
care provider who is convicted of fraud in obtaining
medicaid overpayments.

BY adding to

Article 43 - Health

Section 42J

Annotated Code of Maryland

(1971 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

42J.

ANY HEALTH CARE PROVIDER WHO IS CONVICTED OF FRAUD, OR

WHO SUFFERS A JUDGMENT IN FAVOR OF__THIS__STATE IN A CIVIL

ACTION BASED ON FRAUD, IN OBTAINING MEDICAID OVERPAYMENTS

SHALL BE LIABLE TO THE STATE IN AN AMOUNT TRIPLE TO THE
AMOUNT OF THE OVERPAYMENT AND THE COURT IN EITHER SUCH CASE
SHALL AWARD SUCH SUMS AS PART OF ITS SENTENCE OR JUDGMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

Corrective Bill - Commercial Law Article

FOR the purpose of correcting technical errors in certain
sections of the Commercial Law Article of the Annotated
Code of Maryland.
