VEHICLES, NEW CLASS B VEHICLES, OR NEW COMPLETED TWO-STAGE VEHICLES; (2)                DIRECTS AND SUPERVISES ITS
REPRESENTATIVES IN THIS STATE; OR (3)           SUPERVISES OR CONTACTS ITS DEALERS OR
PROSPECTIVE DEALERS IN THIS STATE. REVISOR'S NOTE: This subsection is new language
derived from Art. 66 1/2, §1-125.1. The definition is revised to cover factory
tranches of any "manufacturer", as defined in
subsection (e) of this section; i.e., not only
manufacturers of Class A or Class B vehicles,
but, also, second—stage manufacturers of
two—stage vehicles, as well. Ch. 425, Acts of
1976, which enacted the new regulations
governing two—stage vehicles, did not
expressly cover factory branches; however,
consistency and an extrapolation of ultimate
intent from the provisions of that Act,
strongly suggest the inclusion of these
factory branches here: (i) the general effect
and obvious intent of the source law to this
subtitle — as it predates Ch. 425, Acts of
1976 - was to require the licensing of factory
tranches of all manufacturers who themselves
would be required to be licensed; (ii) Ch.
425, Acts of 1976, clearly - albeit in
shorthand fashion — was intended to require
second—stage manufacturers (and their
distributors) to be licensed under this
subtitle; (iii) if second-stage manufacturers
are required to be licensed, their branch
offices should be required to be licensed, as
well. This result apparently was the intent
of Ch. 425, Acts of 1976, as explained to the
Commission by the Administration, which
"sponsored" this legislation. Note also that
throughout this subtitle, the present law
tends to treat manufacturers, distributors,
and factory branches alike as to Class A and
Class B vehicles; there certainly appears to
be no reason to do otherwise as to two-class
vehicles. As to the phrase "new Class A ... or Class B
vehicles", see §15-101(c) of this title. As
to the term "two—stage vehicles", see
§15-101(d) of this title. As to the term
"second—stage manufacturer", see subsection
(f) of this section and §13-113.2 of this
article.
