11-165. TAXICAB.
(A) "TAXICAB" MEANS, EXCEPT AS PROVIDED IN
SUBSECTION (B) OF THIS SECTION, A MOTOR VEHICLE FOR HIRE
THAT:
(1) IS DESIGNED TO CARRY SEVEN OR FEWER
INDIVIDUALS OR LESS, INCLUDING THE DRIVER; AND
(2) IS USED TO ACCEPT OR SOLICIT PASSENGERS
FOR TRANSPORTATION FOR HIRE BETWEEN THOSE POINTS ALONG
HIGHWAYS IN THIS STATE AS THE PASSENGERS REQUEST.
(B) "TAXICAB" DOES NOT INCLUDE A MOTOR VEHICLE
OPERATED ON REGULAR SCHEDULES AND BETWEEN FIXED TERMINI
WITH THE APPROVAL OF THE PUBLIC SERVICE COMMISSION.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 66 1/2,
§1-197.
Subsection (a) (2) of this section is revised
to conform more closely to the definition of
"taxicab" in §2(w) of Art. 78 of the Code, the
Public Service Commission Law, where the term
is used with the same basic meaning intended
as in the Maryland Vehicle Law; cf., Art. 78,
§32 (a-1) and (b)(6).
In subsection (b) of this section, the phrase
"on regular schedules and between fixed
termini" is substituted for "on fixed routes
and schedules". This conforms to the Art. 78,
§2(w) definition of "taxicab" and adopts the
defined terms "regular schedule" and "fixed
termini". See revisor's note to §11-143 of
this subtitle.
11-166. TRAFFIC.
"TRAFFIC" MEANS' PEDESTRIANS, VEHICLES AND OTHER
CONVEYANCES, AND RIDDEN OR HERDED ANIMALS, EITHER SINGLY
OR TOGETHER, WHILE USING ANY HIGHWAY FOR TRAVEL.
