In subsection (c) of this section and
throughout this subtitle, the term
"transportation agency", which is defined in
§2-301 of this subtitle, is substituted for
the phrase "modal administrations".
Also in subsection (c), references to the
specific units of the Department are deleted;
these references are unnecessary, and-—in view
of the fact that a temporary member is to be
appointed if the Department itself is the
requesting agency—-they are incomplete.
The only other changes are in style.
2-304. REMOVAL; VACANCIES; CONFLICTS OF INTEREST.
(A) REMOVAL OF MEMBERS.
THE MEMBERS OF THE BOARD MAY BE REMOVED BY THE
GOVERNOR FOR MISCONDUCT, INCOMPETENCY, NEGLECT OF DUTY,
OR OTHER SUFFICIENT CAUSE.
(B) VACANCIES.
A PERMANENT MEMBER APPOINTED TO FILL A VACANCY IN AN
UNEXPIRED TERM SERVES ONLY FOR THE REMAINDER OF THAT
TERM.
(C) CONFLICTS OF INTEREST.
A MEMBER OF THE BOARD MAY NOT PARTICIPATE IN ANY
MATTER BEFORE THE BOARD IN WHICH:
(1) THE MEMBER HAS AN INTEREST; OR
(2) ANY OTHER PERSON, OTHER THAN A
TRANSPORTATION AGENCY, HAS AN INTEREST, IF THE MEMBER IS
OR WITHIN THE PREVIOUS 12 MONTHS HAS BEEN ASSOCIATED WITH
THE OTHER PERSON.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 41,
§231N (b), (c), and (e).
In subsection (b) of this section, the present
statement that the vacancy is filled by
"appointment of the Governor" is deleted as
unnecessary in light of the express provisions
of §2-303(b) of this subtitle.
In subsection (c) of this section, the word
"person" is substituted for "firm,
corporation, partnership or association" since
"person", by definition in §1-101 of this
article, includes the deleted words. The
phrase, in (c) (2), "other than a
transportation agency", is added for clarity.
