General Revisor's Note to this subtitle. 2-303. COMPOSITION; QUALIFICATIONS; TENURE. (A)   IN GENERAL. THE BOARD CONSISTS OF FOUR PERMANENT MEMBERS AND ONE
TEMPORARY MEMBER. (B)   PERMANENT MEMBERS. (1) THE FOUR PERMANENT MEMBERS OF THE BOARD
ARE:
(I) THE SECRETARY, EX OFFICIO, OR HIS
DESIGNEE;
(II) ONE MEMBER APPOINTED FROM THE DEPARTMENT
BY THE GOVERNOR ON RECOMMENDATION OF THE SECRETARY, WHICH
MEMBER SERVES AT THE PLEASURE OF THE GOVERNOR; AND (III) TWO MEMBERS APPOINTED FROM THE GENERAL
PUBLIC BY THE GOVERNOR, AT LEAST ONE OF WHOM IS NOT AN
ARCHITECT OR ENGINEER AND EACH OF WHOM SERVES A TERM OF 4
YEARS AND UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIES. (2) ON RECOMMENDATION OF THE SECRETARY, THE
GOVERNOR MAY APPOINT AN ALTERNATE MEMBER TO SERVE IN THE
ABSENCE OF THE REGULAR MEMBER APPOINTED UNDER THIS
SUBSECTION FROM THE DEPARTMENT. (C) TEMPORARY MEMBER. THE TRANSPORTATION AGENCY THAT IS PRESENTING A
REQUEST TO THE BOARD SHALL APPOINT A TEMPORARY MEMBER OF
THE BOARD. THE TEMPORARY MEMBER SERVES ONLY FOR THE
PURPOSES OF CONSIDERING AND ACTING ON THE REQUEST OF THE
TRANSPORTATION AGENCY BY WHICH HE IS APPOINTED. REVISOR'S NOTE: This section presently appears as
Art. 41, §231N (a)(1) - except for the first
sentence, which now appears as §2—302 of this
subtitle. In subsection (b) of this section, present
references to the right to vote by the
Secretary and the designated alternate are
deleted as unnecessary since that right is
implicit in their respective authority to
serve as members of the Board. In subsection (b) (1) (iii) of this section,
new language is added to indicate that a
member serves until his successor takes
office. This conforms to similar provisions
appearing elsewhere in the Code.
