organization and structure of the State's
comprehensive health planning program, as set forth
in this Executive Order, are consistent with both
State and federal law;
NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF MARYLAND,
PURSUANT TO THE AUTHORITY VESTED IN ME BY ARTICLE
II, SECTION 24 OF THE CONSTITUTION OF MARYLAND, BY
ARTICLE 41, SECTIONS 15C, 15CA, AND 59C, OF THE
ANNOTATED CODE OF MARYLAND, AND BY PUBLIC LAW
93-641, HEREBY ISSUE THE FOLLOWING ORDER, EFFECTIVE
IMMEDIATELY;
1. State Health Planning and Development Agency
(a) The entity created pursuant to Article
41, Section 59C of the Annotated Code of Maryland
and heretofore known as the State's Comprehensive
Health Planning Agency is designated as the State
Health Planning and Development Agency for purposes
of Public Law 93-641.
(b) As required by Article 41, Sections 59C
and 206(e) of the Code, this agency shall be part of
the State Department of Health and Mental Hygiene.
(c) (1) The head of the agency is the
Chairman, who shall be the Secretary of Health and
Mental Hygiene, ex officio.
(2) The chief executive officer of the
agency is the Executive Director, who shall be
appointed by the Governor with the advice of the
Chairman, and who shall have the salary and staff
provided in the State Budget.
(3) The Executive Director is
responsible for the administration of the agency and
the performance of its functions. However, the
decision of the Executive Director, in a contested
case, shall upon application by an aggrieved party,
be considered and approved by the Chairman before it
becomes final in accordance with rules and
regulations adopted by or on behalf of the agency.
(d) The State Health Planning and
Development Agency shall perform the functions,
duties, and responsibilities authorized to be
performed by and specifically delegated to it under
Public Law 93-641; and, to the extent not
inconsistent with Public Law 93-641, it shall
continue to perform the activities authorized by
Article 41, Section 59C of the Code or by other
State law.
