Section 130A(j) Annotated Code of Maryland (1975 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 130A(j) of Article 77 - Public
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
Article 77 - Public Education
130A.
(j) (1) The interagency committee on school
construction created by the Board of Public Works is a
unit within the State Department of Education for
administrative and budgetary purposes. The staff of the
committee may be lent to the committee by the Department
and other State agencies and paid through the budgets of
the agencies employing them. The executive director of
the committee shall be appointed by the committee with
the approval of the Board of Public Works.
          (2) IF A COUNTY BOARD OF EDUCATION OR THE BOARD OF SCHOOL COMMISSIONERS OF BALTIMORE CITY REQUESTS RENOVATION OF AN EXISTING SCHOOL BUILDING, AND IF THE
COST OF THAT RENOVATION DOES NOT EXCEED THE COST OF CONSTRUCTING A NEW BUILDING TO REPLACE THE EXISTING FACILITY, THE INTERAGENCY COMMITTEE ON SCHOOL CONSTRUCTION AND THE BOARD OF PUBLIC WORKS SHALL APPROVE THE REQUEST AND PROVIDE APPROPRIATE FUNDING.
(2) IF A COUNTY BOARD OF EDUCATION OR THE BOARD OF SCHOOL COMMISSIONERS OF BALTIMORE CITY FINDS
AFTER PREPARING FEASIBILITY AND LIFE CYCLE COST STUDIES
IT IS APPROPRIATE AND ECONOMICALLY BENEFICIAL TO RENOVATE
AN EXISTING SCHOOL BUILDING WHICH IN WHOLE OR PART HAS BEEN IN CONTINUOUS EDUCATIONAL USE FOR 40 OR MORE YEARS AND THE COST OF CERTAIN PROPOSED RENOVATION WORK DOES NOT
EXCEED THE EQUIVALENT COST OF REPLACEMENT OF THE BUILDING
OR PART OF A BUILDING OF THE SAME AREA AND PURPOSE, THE
INTERAGENCY COMMITTEE AND THE BOARD OF PUBLIC WORKS SHALL
CONSIDER A REQUEST FOR STATE FUNDING ON THE BASIS OF SUCH
FINDINGS.
(3) FOR THE PURPOSES OF THIS SECTION, REPLACEMENT COST SHALL BE DETERMINED BY THE PRODUCT OF THE AREA OF BUILDING OVER 40 YEARS OF AGE INVOLVED TIMES
THE CURRENT COST PER SQUARE FOOT OF BUILDING CONSTRUCTION
WHICH SHALL NOT INCLUDE SPECIALIZED COSTS OF DEMOLITION,
SITE DEVELOPMENT, ARCHITECTS' AND ENGINEERS' FEES, OR AIR
CONDITIONING. ALL EXISTING AREA NOT AT LEAST 40 YEARS OF
AGE SHALL BE EXCLUDED FROM THIS CALCULATION.
(4) IN ADDITION, AND PRIOR TO ANY
