(3) ONLY ONE SOURCE OF SUPPLY IS AVAILABLE;
OR
(4) IN ITS JUDGMENT, IT IS TO THE BENEFIT OF
THE ADMINISTRATION TO USE THE SERVICES OF STATE
PURCHASING OFFICES.
(F) CERTAIN PURCHASES EXEMPT FROM ARTICLE 41,
§§231G - 231K.
PURCHASES ON BEHALF OF THE ADMINISTRATION OF ROLLING
STOCK AND OTHER PROPERTY PECULIAR TO THE OPERATION OF A
TRANSIT SYSTEM ARE NOT SUBJECT TO ARTICLE 41, §§231G
THROUGH 231K OF THE CODE ON STATE PURCHASES GENERALLY.
REVISOR'S NOTE: This section presently appears as
Art. 64B, §45.
Subsection (c)(1) of this section is added to
indicate clearly that the provisions of
subsection (c) are limited to the contracts
described in subsection (b) (1) (ii) of this
section.
In subsection (d) of this section, the words
"contracting with" are added since this
subsection might well apply to a construction
contract of $10,000 or less and, therefore, is
not limited to purchases only.
Subsection (e)(4) of this section is new
language added for clarity and consistency
with the basically similar provisions
governing airport facilities; see §5-214(e) of
this article.
The only other changes are in style.
As to the exercise of the powers and duties
contained in this section, see §7-203(b) of
this title.
See, also, Order No. 6 of the Joint Standing
Committee on Administrative, Executive and
Legislative Review, September 26, 1975, which
requires publication in the Maryland Register
of "{n}otices of State construction projects
tor which bids were requested" and "{a}wards
of State construction projects". (Vol. 2,
Maryland Register, page 1364.)
