7-404. RELOCATION PROGRAM AND PAYMENTS.
(A) APPLICABILITY OF FEDERAL ACTS.
THE FEDERAL UNIFORM RELOCATION ASSISTANCE AND REAL
PROPERTY ACQUISITION POLICIES ACT OF 1970 AND §7 OF THE
FEDERAL URBAN MASS TRANSPORTATION ACT OF 1964 APPLY TO
PERSONS COVERED BY THOSE ACTS AND DISPLACED FROM REAL
PROPERTY BY ACTION OF THE ADMINISTRATION, WHETHER OR NOT
FINANCIAL ASSISTANCE IS SOUGHT BY OR EXTENDED TO THE
ADMINISTRATION UNDER THOSE ACTS.
(B) RELOCATION PAYMENT MAY NOT BE LESS THAN LEGALLY
REQUIRED.
NOTWITHSTANDING ANY OTHER LAW, A RELOCATION PAYMENT
MADE BY THE ADMINISTRATION MAY NOT BE LESS THAN THAT
REQUIRED BY THE LAW OF THE PLACE WHERE THE ACQUIRED
PROPERTY IS LOCATED.
(C) ADMINISTRATION MAY REIMBURSE ACQUIRING AGENCY.
IF REAL PROPERTY IS ACQUIRED FOR THE ADMINISTRATION
BY A FEDERAL, STATE, OR LOCAL AGENCY OR INSTRUMENTALITY,
THE ADMINISTRATION MAY REIMBURSE THE ACQUIRING AGENCY OR
INSTRUMENTALITY FOR ANY RELOCATION PAYMENTS THAT IT
MAKES.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 64B, §39.
In subsection (a) of this section, reference
to the "Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970",
which is codified as 42 U.S.C. §§4601 et
seq., is added since it repealed and replaced
part of §7 of the Urban Mass Transportation
Act of 1964, the extant portion of which is
codified as 49 U.S.C. §1606 (a). The present
phrase "as the same may from time to time be
amended" is deleted as unnecessary in light of
Art. 1, §21 of the Code; also, the present
reference to "regulations promulgated
thereunder" is deleted as unnecessary.
Also in subsection (a), the word "persons",
which is defined in §1-101 of this article, is
substituted for "individuals, families,
business concerns and nonprofit
organizations". This avoids conflict with the
federal act governing relocation payments;
