717. The State [Roads Commission of Maryland] HIGHWAY
ADMINISTRATION may [make application] APPLY to the
[Board] DIVISION of Correction, similar to the [board]
BOARDS of county commissioners, for a State convict road
force for the construction and maintenance of State
[roads] HIGHWAYS, and be under the same requirements and
conditions as are herein set forth for the [said board]
BOARDS of county commissioners or other county roads
[board] BOARDS of the State of Maryland. 721. Upon receiving such information, the Governor is
authorized, from time to time, to assign such and as many
of said prisoners to the State [Roads Commission] HIGHWAY
ADMINISTRATION as that [Commission] ADMINISTRATION can
profitably employ in the construction, repair, or
maintenance of any of the public [reads] HIGHWAYS and
bridges under its jurisdiction, and it shall thereupon be
the duty of the State [Roads Commission] HIGHWAY
ADMINISTRATION so to employ such prisoners. 722. The county commissioners of any county and the
governing body of any town or city other than Baltimore
City[,] may from time to time request the Governor to
furnish them, respectively, with such number of prisoners
as they can profitably employ in the construction,
repair, or maintenance of any of the public roads,
streets, or bridges under their respective jurisdictions;
and after the Governor has assigned the prisoners to the
State [Roads Commission] HIGHWAY ADMINISTRATION under §
721, such of the total number of prisoners certified to
him under § 720 as may then remain, may be assigned by
the Governor, in such numbers as he may deem equitable,
among and to the employ of the cities, towns, and
counties so applying as aforesaid, for work upon the
public roads and streets thereof. 723. It shall be the duty of the [Board] DIVISION of
Correction to provide for the guarding, transportation,
lodging, feeding, clothing, and medical and other care
and attention of such prisoners while employed on road
work under §§ 719 to 726, or to make such arrangements
therefor as it may deem adequate and proper; and said
[Board] DIVISION may make such rules and regulations as
may be necessary or proper to carry out the provisions of
said sections. When prisoners are assigned to the State
[Roads Commission] HIGHWAY ADMINISTRATION under § 721,
the aforesaid expenses shall be paid by the State, but
when prisoners are assigned UNDER §722 to any city, town
or county[, ] at its request, [under § 722] said expenses
