[(b) Any person engaging in the fitting and sale of
hearing aids, will, prior to engaging in such practice
with a child twelve (12) years of age or under, ascertain
whether the child has been examined by an
otolaryngologist within the previous ninety days. If
the child has not been examined by an otolaryngologist
within the previous ninety days, the person engaging in
the fitting and sale of hearing aids must make a written
recommendation for such an examination prior to the
fitting or selling of a hearing aid for the child.]
SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 739A be and it is hereby added to Article 43 -
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1976 Supplement) to read as
follows:

|
ANY HEARING AID DEALER, PRIOR TO ENGAGING IN THE
PRACTICE OF FITTING AND SELLING OF HEARING AIDS WITH
RESPECT TO ANY PERSON, SHALL ASCERTAIN WHETHER THAT
PERSON HAS BEEN EXAMINED BY AN OTOLARYNGOLOGIST OR
PHYSICIAN , OTOLOGIST, OR OR PHYSICIAN, OR AUDIOLOGIST
WITHIN THE PREVIOUS 90 DAYS SIX MONTHS. IF THE PERSON
HAS NOT BEEN SO EXAMINED, THE HEARING AID DEALER (1)
SHALL MAKE A WRITTEN RECOMMENDATION FOR SUCH AN
EXAMINATION OF THE PERSON, AND (2) MAY NOT FIT OR SELL
THAT PERSON A HEARING AID UNTIL SATISFACTORY WRITTEN
EVIDENCE OF A HEARING EXAMINATION BY AN OTOLARYNGOLOGIST
OR PHYSICIAN , OTOLOGIST, OR PHYSICIAN, OR AUDIOLOGIST
HAS BEEN FURNISHED TO THE DEALER. ANY PERSON 18 YEARS OF
AGE OR OLDER MAY WAIVE IN WRITING SUCH EXAMINATION.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
