(House Bill 31)
AN ACT concerning
Hearing Aid Dealers - Prior Examination of Customers
FOR the purpose of requiring hearing aid dealers to
determine whether a prospective purchaser of a
hearing aid has been examined by a hearing
specialist or physician within a certain previous
period of time; and providing that if such a hearing
examination has not been made, the hearing aid
dealer must make a written recommendation for the
examination and may not fit or sell a hearing aid
until he is furnished with proof of that examination
or waiver; and repealing a prevision relating to
hearing examinations of children under a certain
age.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 739 of Article 43 - Health, of the
Annotated Code of Maryland (1971 Replacement Volume and
1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 43 - Health
739.
[(a)] Any person who practices the fitting of or
dealing in hearing aids shall deliver to each person
supplied with a hearing aid, by him or at his order or
direction, a receipt which contains his signature and
shows the address of his regular place of practice and
the number of his certificate, together with a
specification of the hearing aid furnished and the amount
charged therefor.
