CHAPTER 688
(Senate Bill 128)
AN ACT concerning
Baltimore City — Location of Landfills Near Hospitals
FOR the purpose of prohibiting the Secretary of Health
and Mental Hygiene from issuing a permit for a
proposed landfill system of refuse disposal when the
proposed landfill system is located in Baltimore
City and is within a certain distance of any
hospital.

Section 394 (c)
Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 394(c) be and it is hereby
added to Article 43 — Health, of the Annotated Code of
Maryland (1971 Replacement Volume and 1976 Supplement) to
read as follows:
Article 43 - Health
394.
(C) THE SECRETARY OF HEALTH AND MENTAL HYGIENE MAY
NOT ISSUE A PERMIT UNDER THE PROVISIONS OF THIS SECTION
FOR ANY PROPOSED LANDFILL SYSTEM OR REFUSE DISPOSAL WHEN
THE PROPOSED LANDFILL SYSTEM IS LOCATED IN BALTIMORE CITY
AND IS WITHIN ONE ONE-HALF MILE OF ANY HOSPITAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1977.
