AN ACT concerning
Anne Arundel County Board of Education - Hearing Examiner
FOR the purpose of permitting the Anne Arundel County
Board of Education to allow a hearing examiner to
hear proceedings brought before the board under
certain circumstances; requiring the hearing
examiner to report to the Board of Education;
establishing an appeal process; and generally
relating to the use of a hearing examiner by the
Anne Arundel County Board of Education.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 114D be and it is hereby added
to Article 77 — Public Education, of the Annotated Code
of Maryland (1975 Replacement Volume and 1976 Supplement)
to read as follows:

114D.
IN ALL PROCEEDINGS BEFORE THE BOARD OF EDUCATION OF
ANNE ARUNDEL COUNTY PURSUANT TO §§ 59 AND 114, THE BOARD
MAY CAUSE THE PROCEEDINGS TO BE HEARD INITIALLY BY A
HEARING EXAMINER, WHO IS APPOINTED BY THE BOARD. THE
HEARING EXAMINER SHALL SUBMIT A TRANSCRIPT OF THE
PROCEEDINGS AND EXHIBITS, HIS FINDINGS OF FACT AND
CONCLUSIONS OF LAW, AND HIS RECOMMENDATIONS TO THE BOARD
OF EDUCATION AND THE APPELLANT. THE BOARD SHALL ALLOW
PARTIES TO THE PROCEEDINGS BEFORE THE HEARING EXAMINER AN
OPPORTUNITY TO MAKE ARGUMENTS BEFORE IT. FOLLOWING A
REVIEW OF THE RECORD AND THE RECOMMENDATIONS, THE BOARD
SHALL RENDER A DECISION, WHICH IS SUBJECT TO FURTHER
APPEAL TO THE STATE BOARD OF EDUCATION AS PROVIDED IN
THIS ARTICLE. THE BOARD OF EDUCATION OF ANNE ARUNDEL
COUNTY SHALL ADOPT REASONABLE RULES AND REGULATIONS TO
GOVERN THE CONDUCT OF PROCEEDINGS BEFORE THE HEARING
EXAMINER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
