(A) [Said Board so appointed and it successors,
shall be known by the name of the] THERE IS A Board of
Examiners in Optometry [of the State of Maryland] IN THE
DEPARTMENT.
(B) THE BOARD CONSISTS OF FIVE MEMBERS. THE
GOVERNOR, ON RECOMMENDATION OF THE SECRETARY, SHALL
APPOINT EACH MEMBER FROM A LIST OF THREE NAMES SUBMITTED
BY THE MARYLAND OPTOMETRIC ASSOCIATION. EACH MEMBER
SHALL HAVE FOR A PERIOD OF FIVE YEARS BEFORE APPOINTMENT,
RESIDED IN THIS STATE AND ACTIVELY AND CONTINUOUSLY
ENGAGED IN THE PRACTICE OF OPTOMETRY IN THIS STATE.
(C) EACH MEMBER SERVES FOR A TERM OF FOUR YEARS
AND UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIES.
TERMS OF THE MEMBERS SHALL REMAIN STAGGERED AS REQUIRED
FOR PREVIOUS APPOINTMENT TO THE BOARD. A MEMBER
APPOINTED TO FILL A VACANCY OR TO SUCCEED A MEMBER
HOLDING OVER SERVES ONLY FOR THE REMAINDER OF THE
UNEXPIRED TERM.
(D) Every person [so] appointed to [serve on
said] THE Board shall receive a certificate of his
appointment from the Governor [of the State of Maryland,]
and, within ten days after receiving [such] THE
certificate [he] shall take, subscribe and file in the
office of the Secretary of State the constitutional oath
of office.

[Said Board shall meet within] WITHIN ten days after
[their] appointment [has been made and], THE BOARD SHALL
MEET AND choose a president, secretary and treasurer from
ITS members [thereof] and adopt a common seal, and
biennially thereafter shall elect such officers. Each
member shall have the power to administer oaths and take
affidavits concerning all matters properly COGNIZABLE by
[said] THE Board[ , certifying thereto under the hand and
seal of the Board]. [Said] THE Board shall meet in the
City of Baltimore at least twice a year and as often
thereafter as may be necessary, and in addition [thereto]
whenever the Board or the Secretary of Health and Mental
Hygiene shall call a meeting. A majority of [said] THE
Board [shall at all times constitute] CONSTITUTES a
quorum. The secretary of [said] THE Board shall keep a
full record of [the] ITS proceedings [of said Board],
which shall at all reasonable times be open to public
inspection. [The treasurer shall receive from the
secretary all fees paid for licenses and certificates and
shall keep a record thereof, and of all disbursements of
said Board in a book to be kept for that purpose. All
moneys paid to the Board shall be deposited by the
treasurer in some safe banking institution, and all
moneys paid out shall be approved by said Board and be
made by check signed by both the president and the
treasurer. The treasurer shall, upon entering the
