SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 7-501(y) through (bb),
respectively, of Article — Natural Resources, of the
Annotated Code of Maryland (1974 Volume and 1976
Supplement) be and they are hereby renumbered to be
Sections 7—501(z) through (cc), respectively.
SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 7-501(y) and 7-514.6 be and they are hereby
added to Article — Natural Resources, of the Annotated
Code of Maryland (1974 Volume and 1976 Supplement) to
read as follows;:

(Y) "PROSPECT" MEANS THE REMOVAL OF SOIL OR ROCK
MATERIAL OVERLYING BITUMINOUS COAL TO DETERMINE THE
LOCATION OR VALUE OF THE COAL RESOURCE OF THE AREA, BUT
NOT TO SELL, EXCHANGE, OR TRANSFER.

(A) A PERSON MAY NOT PROSPECT UNLESS THE PERSON
FIRST:
(1) SUBMITS TO THE BUREAU THE WRITTEN
CONSENT OF THE LANDOWNER OR THE OWNER OF THE MINING
RIGHTS;
(2) OBTAINS THE BRITTEN APPROVAL OF THE
BUREAU; AND
(3) FILES WITH THE BUREAU A BOND PAYABLE TO
THE STATE, CONDITIONED ON FAITHFUL PERFORMANCE OF THE
REQUIREMENTS OF THIS SECTION, AND IN THE AMOUNT THAT THE
