SECRETARY DETERMINES NECESSARY TO ASSURE COMPLETION OF
RECLAMATION AND REVEGETATION.
(B) EACH PERSON WHO PROSPECTS AN AREA SHALL
RECLAIM IT, INCLUDING BACKFILLING AND REVEGETATION IN
ACCORDANCE WITH THE STANDARDS THAT THE BUREAU ADOPTS FOR
OPEN-PIT MINING OPERATIONS.
SECTION 3. AND BE IT FURTHER ENACTED, That Sections
7—516(f) and (g) of Article - Natural Resources, of the
Annotated Code of Maryland (1974 Volume and 1976
Supplement) be and they are hereby repealed:

[(f) The provisions of this subtitle do not apply
to any person engaged in prospecting for coal if no coal
is marketed.
(g) Any person or operator who fails to backfill
any prospected area within a reasonable time in
accordance with the Bureau's rules and regulations is
guilty of a misdemeanor and upon conviction subject to a
fine of not less than $200 or more than $500.]

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
