observation towers, radio towers, water tanks and towers,
trestles, piers, paving, bulkheads, wharves, sheds, coal
bins, shelters, fences and display signs[; the term
"structure" shall also include], THE TERM ALSO INCLUDES
natural land formations[; the] AND APPURTENANCES AND
ENVIRONMENTAL SETTINGS. THE term ["structure"] shall be
construed as if followed by the words "or part thereof."
[The words "appurtenances and environmental settings"
shall include, but not be limited to] APPURTENANCES" AND
"ENVIRONMENTAL SETTINGS" INCLUDE walkways and driveways
(whether paved or not), trees, landscaping, and rocks.
[Where hereafter used in this subtitle the word
"structure" shall be determined to include the words
"appurtenances and environmental settings."] IN THIS
SUBTITLE, "DEMOLITION" INCLUDES, IN MUNICIPAL
CORPORATIONS ONLY, ANY WILFUL NEGLECT IN MAINTENANCE AND
REPAIR OF A STRUCTURE, NOT INCLUDING ANY APPURTENANCES
AND ENVIRONMENTAL SETTINGS, HELD OR USED IN A TRADE OR
BUSINESS OR FOR THE PRODUCTION OF INCOME, THAT DOES NOT
RESULT FROM FINANCIAL INABILITY TO MAINTAIN AND REPAIR
THE STRUCTURE AND THAT THREATENS TO RESULT IN ANY
SUBSTANTIAL DETERIORATION OF THE EXTERIOR FEATURES OF THE
STRUCTURE.
SECTION 2. AND BE IT FURTHER ENACTED, That any
ordinance or resolution concerning demolition in effect
prior to July 1, 1976 shall continue in effect and be
considered valid for all purposes according to its terms.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
