(Senate Bill 524) AN ACT concerning Anne Arundel County - Exceptions to Prerequisites
for Recording Instruments FOR the purpose of providing an exception to the
prerequisite to recording instruments among the Land
Records of Anne Arundel County that all applicable
taxes shall have been paid which exception shall
apply to the grant of a right-of-way or other
easement
transfer of property to the County when
that conveyance does not impair the security for the
taxes. BY adding to Article - Real Property
Section 3-104(c)(3)
Annotated Code of Maryland
(1974 Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 3-104(c)(3) be and it is
hereby added to Article — Real Property, of the
Annotated Code of Maryland (1974 Volume and 1976
Supplement) to read as follows: Article - Real Property 3-104. (c) (3) EXCEPTION FOR CERTAIN DEEDS IN ANNE
ARUNDEL COUNTY. THE PROVISIONS OF SUBSECTION (B) DO NOT APPLY IN ANNE ARUNDEL COUNTY TO ANY DEED GRANTING A RIGHT OF WAY OR OTHER EASEMENT TRANSFERRING PROPERTY TO THE COUNTY WHEREON THE CONTROLLER OF THE COUNTY HAS
CERTIFIED THAT THE CONVEYANCE DOES NOT IMPAIR THE
SECURITY FOR ANY PUBLIC TAXES, ASSESSMENTS, AND CHARGES
DUE ON THE REMAINING PROPERTY OF THE GRANTOR.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977. Approved May 17, 1977.
