PERSON ANY MOTOR VEHICLE FOR WHICH ANY CHARGE IS BASED ON
THE DISTANCE TRAVELED, IF THE PERSON KNOWS THAT THE
VEHICLE'S ODOMETER DOES NOT RECORD CORRECTLY ITS ACTUAL
ACCUMULATED MILEAGE; OR
(2) OTHERWISE RENT TO ANY OTHER PERSON ANY MOTOR
VEHICLE FOR WHICH ANY CHARGE IS BASED ON THE DISTANCE
TRAVELED AND DECEIVE THAT OTHER PERSON AS TO THE DISTANCE
THAT THE VEHICLE TRAVELED DURING THE RENTAL PERIOD.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 27, §202.
The last clause of present §202, which
establishes penalties for violation of this
section, is transferred in effect to Title 27
of this article and incorporated in §27—101(d)
of this article.
As to general prohibitions against tampering
with or altering an odometer, see §22—415 of
this article.
18-105. SAME—PERSONS UNDER INFLUENCE OF ALCOHOL OR
DRUGS.
A PERSON MAY NOT RENT A MOTOR VEHICLE TO ANY OTHER
PERSON IF HE KNOWS THAT THE OTHER PERSON OR THE
INDIVIDUAL WHO WILL DRIVE THE RENTED VEHICLE IS UNDER THE
INFLUENCE OF ALCOHOL OR DRUGS.
REVISOR'S NOTE: This section is new language derived
from Art. 27, §203.
The phrase "or the individual who will drive
the ... vehicle" is new language patterned
after that appearing in §18-103(a) of this
title and added to reflect situations such as
where the contractual lessee is not a natural
person or otherwise where the lessor knows
that the lessee has rented the vehicle for
operation by another.
The last clause of present §203, which
establishes penalties of up to $100 and 30
days for violation of this section, is deleted
in deference to the standard penalty
established by §27-101(b) of this article.
The only other changes are in style.
18-106. UNAUTHORIZED USE OF RENTED MOTOR VEHICLE.
IF A PERSON RENTS A MOTOR VEHICLE UNDER AN AGREEMENT
NOT TO PERMIT ANOTHER PERSON TO DRIVE THE VEHICLE:
