Annotated Code of Maryland (As enacted by Chapter 14 of the Acts of the
General Assembly of 1977)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 61A, 202, 203, 204, 208, and 449
of Article 27 — Crimes and Punishments, of the Annotated
Code of Maryland (1976 Replacement Volume and 1976
Supplement) be and they are hereby repealed. REVISOR'S NOTE: Art. 27, §204 prohibits a person
from tampering with the "hubodometer" of a
rental motor vehicle with intent to defraud,
subject to a penalty of up to $100 and 30
days. This section, first enacted in 1927, is
obsolete and has been superseded by the
broader prohibitions of §22—415 of the
Transportation Article; Tr §22—415 - which is
subject to the higher penalties of Tr
§27—101(d) - generally prohibits tampering
with the odometer of any motor vehicle and
does not require fraudulent intent. (See,
also, Tr §§ 14-104 and 27-101(c)(4).)
Accordingly, Art. 27, §204 is proposed for
repeal.
Art. 27, §449 prohibits a person from
"wilfully" placing on any highway any
substance that may injure a pneumatic tire,
subject to a penalty of up to $50. This
section, first enacted in 1896, is obsolete
and has been superseded by the broader
prohibitions of §21—1111 of the Transportation
Article; Tr §21—1111 - which is subject to the
higher penalties of Tr §27-101(b) - generally
prohibits the dropping, throwing, or placement
on any highway of any substance likely to
injure "any person, animal, or vehicle on the
highway". Accordingly, Art. 27, §449 is
proposed for repeal.
SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 18-104, 18-105, 18-106, and 20-106 be and they
are hereby added to Article — Transportation, of the
Annotated Code of Maryland (As enacted by Chapter 14 of
the Acts of the General Assembly of 1977) to read as
follows: Article — Transportation 18-10 4. SAME -—VEHICLE WITH INCORRECT ODOMETER. A PERSON MAY NOT:
(1) WITH INTENT TO DEFRAUD, RENT TO ANY OTHER
