LAWS OF MARYLAND
AN ACT concerning Physicians - Staff Privileges FOR the purpose of requiring reports to the Commission on
Medical Discipline by hospitals and related
institutions taking certain actions on physicians'
staff privileges as a result of unprofessional
conduct and by courts after conviction of physicians
for certain crimes; giving the Commission subpoena
power; providing certain immunity for persons making
the required reports and limiting access to the
report. BY adding to Article 43 - Health Section 130A Annotated Code of Maryland (1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 130A be and it is hereby added
to Article 43 — Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement) to read as
follows:
Article 43 - Health
130A.
(A)    (1) EACH HOSPITAL AND RELATED INSTITUTION
SHALL REPORT TO THE COMMISSION EACH DENIAL OF A
PHYSICIAN'S APPLICATION FOR STAFF PRIVILEGES AND EACH
LIMITATION, REDUCTION, OR TERMINATION OF PREVIOUSLY
GRANTED STAFF PRIVILEGES IF THE ACTION RESULTS FROM ANY
OF THE CAUSES LISTED IN § 130(H) OF THIS ARTICLE AS
UNPROFESSIONAL CONDUCT, OR ANY VOLUNTARY RESIGNATION OF A PHYSICIAN WHILE THE PHYSICIAN IS UNDER FORMAL__ ACCUSATION OF ACTIVITIES LISTED IN §130(H) OF THIS ARTICLE. (2) THE REPORT SHALL BE SUBMITTED WITHIN   TEN DAYS AFTER THE HOSPITAL OR RELATED INSTITUTION ACTS     ON THE STAFF PRIVILEGES AND SHALL SPECIFY THE REASONS   FOR
THE ACTION. (3) IN NO EVENT SHALL ANY MINUTES OR NOTES TAKEN IN THE COURSE OF DETERMINING THE DENIAL, LIMITATION, REDUCTION OR TERMINATION OF STAFF__PRIVILEGES BE SUBJECT TO REVIEW OR DISCOVERY BY ANY PERSON. (B)    EACH COURT SHALL REPORT TO THE COMMISSION EACH CONVICTION OF A PHYSICIAN OF ANY CRIMINAL CHARGE, OTHER THAN THOSE TRAFFIC VIOLATIONS THE PENALTY FOR WHICH DOES NOT INVOLVE THE POSSIBILITY OF IMPRISONMENT, FOR ANY CRIME INVOLVING MORAL TURPITUDE WITHIN TEN DAYS AFTER
THE CONVICTION.
