SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 36D (d) through (h), respectively,
of Article 77 — Public Education, of the Annotated Code
of Maryland (1975 Replacement Volume and 1976 Supplement)
be and they are hereby renumbered to be Sections 36D (e)
through (i), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 36D(d) be and it is hereby added to Article 77 —
Public Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) to read as
follows:
Article 77 — Public Education
36D.
(D) IF MORE THAN TWO PERSONS FILE AS CANDIDATES
FOR EACH VACANCY ON THE BOARD, THE ALLEGANY COUNTY BOARD
OF ELECTIONS SUPERVISORS SHALL HOLD A PRIMARY ELECTION TO
REDUCE THE NUMBER OF CANDIDATES TO TWO PER VACANCY ON THE
BOARD.
SECTION 3. AND BE IT FURTHER ENACTED, That Section
36D(c) of Article 77 — Public Education, of the Annotated
Code of Maryland, (1975 Replacement Volume and 1976
Supplement) be and it is hereby repealed and reenacted,
with amendments, to read as follows:
Article 77 - Public Education
36D.
(c) Nomination for membership on the Allegany
County Board of Education shall be by petition signed by
at least [two hundred (200)] 200 voters from the County.
Each petition shall be filed with the board of
supervisors of elections of Allegany County not later
than 9 p.m. on the Monday which is ten weeks or [seventy]
70 days before the day on which the [general] PRIMARY
election is held. Each petition shall conform generally
to the laws and requirements in Article 33 of this Code,
but publication of each petition shall not be reguired.
