SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 28(a) of Article 77 - Public
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

|
|
(a) The State Superintendent of Schools shall
approve any program of instruction offered by any State
institution under the supervision of the Department of
Juvenile Services, Department of Correctional Services,
THE RESIDENTIAL SCHOOL LOCATED WITHIN__THE INSTITUTE OF
PSYCHIATRY AND HUMAN BEHAVIOR OF THE UNIVERSITY HOSPITAL,
and the Department of Mental Hygiene, provided that such
program shall be based upon and comply with such
standards as may be established by regulations of the
State Board of Education with and upon the advice of the
State Superintendent of Schools. Upon such approval the
State Superintendent of Schools shall issue a certificate
of approval for such program to any such institution by
which it is offered. Any certificate may be revoked at
any time for cause by the State Superintendent of
Schools. Any such institution shall be open for
inspection of such program by the State Superintendent of
Schools or his designated agent at all reasonable times
and shall furnish such information and reports from time
to time as the State Superintendent of Schools shall deem
necessary and proper for the evaluation of the program.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure and
necessary for the immediate preservation of the public
health and safety and having been passed by a yea and nay
vote supported by three-fifths of all the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.
