89B, §120D. Although former Art. 89B, §120D previously has
been decodified (see General Revisor's Note to
Title 3 of this article), this section is
included here to give public notice of the
sign requirement, the responsibility for which
was transferred to the Authority from the
State Roads Commission (see §4—209 of this
subtitle and its revisor's note). The section is revised to require the signs to
be placed at the approaches to the tunnel
"throughway" rather than the approaches to the
"tunnel" itself. In most instances, if a
motorist is already on the throughway and
approaching the tunnel proper, he has little,
if any, choice of an alternate route. The last sentence of former §120D(a), which
defines "approaches", is omitted as
unnecessary. 4-403. RAILROAD TRACKS ON KENNEDY HIGHWAY PROHIBITED. THE AUTHORITY MAY NOT PERMIT ANY PERSON TO LOCATE
RAILROAD TRACKS ON ANY PART OF THE JOHN F. KENNEDY
MEMORIAL HIGHWAY. REVISOR'S NOTE: This section is new language derived
without substantive change from the provisions
of former Art. 89B, §149(b) prohibiting use of
the John F. Kennedy Memorial Highway for
"tracks for railroad or railway use".
Although former Art. 89B, §149(b) previously
has been decodified (see General Revisor's
Note to Title 3 of this article), this section
and §4—404 of this subtitle are included here
to give public notice of these operative
provisions. 4-404. SERVICE FACILITIES ON KENNEDY HIGHWAY. (A)   AUTHORITY TO CONSTRUCT. THE AUTHORITY SHALL CONSTRUCT ANY GASOLINE SERVICE
FACILITIES THAT IT FINDS TO BE NEEDED ON THE JOHN F.
KENNEDY MEMORIAL HIGHWAY. (B)   LEASING OF FACILITIES. (1) TO GIVE USERS OF THE HIGHWAY A
REASONABLE CHOICE OF MOTOR FUELS MANUFACTURED, PRODUCED,
OR MARKETED BY DIFFERENT COMPANIES, EACH GASOLINE
SERVICE STATION SHALL BE OFFERED SEPARATELY FOR LEASE ON
SEALED BIDS TO THE HIGHEST RESPONSIBLE BIDDER. NOTICE
OF THE OFFER SHALL BE PUBLISHED ONCE A WEEK FOR 3
SUCCESSIVE WEEKS IN A NEWSPAPER OF GENERAL CIRCULATION IN
